Amendments to the Courts of Judicature Act 1964, Subordinate Courts Act 1948 and Subordinate Courts Rules Act 1955

INTRODUCTION

On 22 October 2020, the Courts of Judicature (Amendment) Act 2020 (Act A1621), the Subordinate Courts (Amendment) Act 2020 (Act A1622) and the Subordinate Courts Rules (Amendment) Act 2020 (Act A1623) all come into operation.

1. Act A1621: Courts of Judicature (AMENDMENT) ACT 2020

Act A1621 is an Act to amend the Courts of Judicature Act 1964 which introduced the following key amendments:

  • Section 3: amendment to insert the definition of ‘remote communication technology’ which means a live video link, a live television link or any other electronic means of communications;
  • Section 15A: new section to allow the Federal Court, Court of Appeal and the High Court to conduct proceedings through remote communication technology;
  • Section 16: amendment to insert paragraph (aa) that regulates and prescribes the procedure with respect to the hearing of any matter or proceeding through a remote communication technology;
  • Section 17(2): amendment to appoint the Chief Registrar of the Federal Court as the new member of Rules Committee replacing the Senior Judge of the Sessions Court
  • Section 17B: new section to empower the Chief Justice to issue Practice Directions after consultation with the President of Court of Appeal or the Chief Judge; and
  • Section 69: amendment to allow receiving further evidence via remote communication technology.

2. ACT 1622: SUBORDINATE COURTS (AMENDMENT) ACT 2020

Act A1622 is an Act to amend the Subordinate Courts Act 1948 which introduced the following key amendments: 

  • Section 2: amendment to insert the definition of ‘remote communication technology’;
  • Section 101B: new section to allow the Sessions Court and the Magistrates’ Court to conduct proceedings through remote communication technology; and
  • Section 107A: new section to empower the Chief Justice to issue Practice Directions after consultation with the President of Court of Appeal or the Chief Judge.

3.  ACT A1623: SUBORDINATE COURT RULES (AMENDMENT) ACT 2020

Act A1623 is an Act to amend the Subordinate Courts Rules Act 1955 which introduced the following key amendments: 

  • Section 2: amendment to insert the definition of ‘remote communication technology’;
  • Section 3(2): amendment to appoint the Chief Registrar of the Federal Court as the new member of Subordinate Courts Rules Committee replacing the Senior Judge of the Sessions Court; and
  • Section 4: amendment to insert paragraph (aa) that regulates and prescribes the procedure with respect to the hearing of any matter or proceeding through a remote communication technology.
