The operation of Part II of the Temporary Measures for Reducing the Impact of Coronavirus Disease 2019 (Covid-19) Act 2020 (“the COVID-19 Act”) which is due to expire on 31 December 2021 has been further extended for the period from 1 January 2022 to 22 October 2022.
Part II of the Covid-19 Act essentially provides temporary reliefs for :-
(a) parties who are unable to perform their contractual obligations arising from any of the categories of contracts specified in the Schedule to Part II Covid-19 Act ("Scheduled Contracts") from 18 March 2020 onwards due to the measures prescribed, made or taken under the Prevention and Control of Infectious Diseases Act 1988 ("the PCID Act") to control or prevent the spread of Covid-19 (see Section 7 of the Covid-19 Act); and
(b) any disputes arising from the Scheduled Contracts due to the measures prescribed, made or taken under the PCID Act to control or prevent the spread of Covid-19 which may be settled by way of mediation (see Section 9 of the Covid-19 Act).
